By accessing or using FuelYourDNA ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
These terms apply to all users, including visitors, registered users, and paying subscribers.
2. Description of Service
FuelYourDNA provides personalized nutrition recommendations based on genetic analysis. Our service includes:
- Analysis of uploaded DNA raw data files
- Identification of genetic variants related to nutrition
- Personalized dietary recommendations
- Recipe suggestions based on your genetic profile
- Educational content about nutrigenomics
Medical Disclaimer: FuelYourDNA is NOT a medical service. Our reports and recommendations are provided strictly for general informational and educational purposes only and do not constitute medical advice, diagnosis, treatment recommendations, dietary prescriptions or a professional opinion of any kind. They are not a substitute for the independent clinical judgment, expertise and training of a qualified healthcare professional with knowledge of your individual circumstances, medical history, allergies, contraindications, concurrent medications or overall health status. This Service is not intended for children, or for women who are pregnant or nursing. FuelYourDNA reports have not been cleared or approved by the FDA, EMA, ANSM or any other health authority. Always consult a qualified healthcare provider before making changes to your diet, supplementation or health regimen.
3. User Accounts
3.1 Registration
To use our Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Age Requirement
You must be at least 18 years old to use our Service. By creating an account, you confirm that you are at least 18 years of age.
3.3 Account Responsibility
You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. DNA Data and Privacy
4.1 Your DNA Data
By uploading your DNA data, you represent that:
- The DNA data belongs to you or you have authorization to upload it
- You consent to our analysis of this data for nutritional purposes
- You understand that raw DNA files are deleted after processing
Data Protection: We take your genetic privacy extremely seriously. Your data is encrypted, never sold, and raw files are permanently deleted after analysis. See our Privacy Policy for full details.
4.2 Data Deletion
You may request deletion of all your data at any time through your account settings or by contacting us. Upon deletion, all your genetic data will be permanently removed from our systems.
5. Subscription and Payments
5.1 Pricing
Our Service offers various subscription plans. Prices are displayed in your local currency and may vary by region. All prices are inclusive of applicable taxes unless otherwise stated.
5.2 Payment Processing
Payments are processed securely through Stripe. We do not store your payment card information. By providing payment information, you authorize us to charge the applicable fees.
5.3 Refund Policy
- Within 14 days: Full refund if analysis has not been completed
- After analysis: No refund as the service has been delivered, except under the satisfaction guarantee in section 5.6
- Technical issues: Full refund if we cannot process your DNA file
5.4 Subscription Cancellation
You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds for unused time.
5.5 EU Right of Withdrawal (Digital Content)
Under EU Directive 2011/83/EU on consumer rights, consumers within the European Union normally have a 14-day right of withdrawal for online purchases. Because your report is digital content delivered immediately upon completion of the analysis, you expressly consent at checkout to the immediate performance of this service and acknowledge that you thereby lose your right of withdrawal once the report has been delivered, in accordance with Article 16(m) of the Directive.
5.6 Satisfied or refunded guarantee
In addition to your legal rights, if a report you bought does not meet your expectations, write to info@fuelyourdna.com within 14 days of your purchase, from the e-mail address used for the order, and we will refund the full price paid, without having to give a reason. The refund is made to the original payment method, usually within 10 working days. The guarantee applies once per customer and per type of report.
6. Acceptable Use
You agree NOT to:
- Upload DNA data that does not belong to you without authorization
- Use the Service for any illegal purpose
- Attempt to reverse-engineer our algorithms
- Share your account credentials with others
- Use automated systems to access the Service
- Upload malicious files or attempt to compromise our systems
7. Intellectual Property
All content, features, and functionality of FuelYourDNA (including but not limited to text, graphics, logos, algorithms, and software) are owned by FuelYourDNA and are protected by intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8. Limitation of Liability
Important: To the maximum extent permitted by applicable law, in no event shall FuelYourDNA, its directors, officers, employees, agents, affiliates, licensors, suppliers, partners, successors or assigns be liable to any person for any indirect, incidental, special, consequential, punitive or exemplary damages arising out of or in connection with the Service or any report, regardless of the cause of action or theory of liability (whether in contract, tort, negligence, strict liability, breach of statutory duty or otherwise), and regardless of whether FuelYourDNA has been advised of the possibility of such damages.
Without limiting the foregoing, FuelYourDNA is NOT responsible for:
- Any health outcomes resulting from following our recommendations
- Accuracy of genetic analysis (DNA testing limitations apply)
- Decisions made based on our recommendations
- Any indirect, incidental, special, consequential, punitive or exemplary damages
Our total aggregate liability arising out of or in connection with the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Third-Party Products and Supplements
Any references to third-party products, supplements, foods or brands in our reports, recommendations or website are included for informational purposes only. Such references do not constitute an endorsement, recommendation or guarantee by FuelYourDNA of the safety, efficacy, quality, suitability or appropriateness of any such product for any particular individual.
FuelYourDNA has no liability whatsoever in respect of any third-party products or supplements referenced. Any person considering the use of any such product should consult with a qualified healthcare professional and independently evaluate its suitability, including potential interactions, contraindications and allergies.
10. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the fullest extent permitted by applicable law, FuelYourDNA expressly disclaims all representations and warranties, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, compatibility, or arising from any course of dealing or usage of trade. We do not guarantee that:
- The Service will be uninterrupted or error-free
- Results will be 100% accurate
- The Service will meet your specific requirements
11. Indemnification
You agree to indemnify and hold harmless FuelYourDNA from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service at any time. We will provide reasonable notice for significant changes affecting paid subscribers.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of France, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
